The following terms will be included on the contract that must be signed to confirm your booking. Please read thoroughly.

SIPS BY SKYY, LLC

TERMS OF SERVICE & CLIENT AGREEMENT

This Terms of Service and Client Agreement (“Agreement”) is entered into between Sips by Skyy, LLC (“Sips by Skyy,” “Company,” “we,” “us,” or “our”) and the undersigned client (“Client” or “Host”) for mobile bartending services.

By booking services with Sips by Skyy, the Client agrees to the following terms and conditions.

1. Services Provided

Sips by Skyy, LLC provides professional mobile bartending services for private events, which may include:

  • Bartending service for the booked duration

  • Bar setup and breakdown

  • A curated Mood by Skyy™ Signature Menu consisting of up to 3 signature drinks or

  • Beer and wine menu or

  • Mimosa Bar menu

  • Personalized alcohol guide and shopping list

  • Cocktail and mocktail service

  • Optional add-ons selected by the Client

Sips by Skyy does not sell, supply, purchase, or transport alcohol.

All alcohol must be provided by the Client.

2. Booking & Reservation

A booking is not confirmed until:

  • The contract is signed, and

  • The required deposit is received

Dates are not held without payment. Verbal or written inquiries alone do not guarantee availability.

3. Minimum Booking & Pricing

  • All Mood by Skyy™ events require a minimum four (4) hour booking

  • The classic bar option events require a minimum of two (2) hour booking

  • Hourly rates are based on guest count tiers

  • Pricing includes service time, setup, breakdown, preparation, and staffing

Rates are non-negotiable and subject to change for future bookings.

4. Mood by Skyy™ Signature Menu

  • Each event includes a curated signature drink menu based on one (1) mood selected by the Client.

  • Menus include up to 3 custom drinks

  • Menus are created specifically for the event

  • Menu selections must be finalized prior to the event

  • Once approved, only minor adjustments may be made

  • Guests are served exclusively from the curated menu

Signature menus are not guaranteed to be recreated for future events.

5. Add-Ons

Optional add-ons may include, but are not limited to:

  • Additional signature drinks

  • Second mood selection

  • Luxury garnish bar

  • Themed bar styling

  • Hydration station

  • Server (s)

  • Milage Add-on

All add-ons must be selected and confirmed prior to the event date and are subject to availability.

6. Travel & Mileage Fees

Travel within a designated local radius is included. Events outside this radius are subject to a flat travel fee based on distance.

Mileage fees are disclosed prior to booking and are non-refundable.

7. Payment Terms

A non-refundable deposit is required to secure the booking

Remaining balance is due prior to the event date

Failure to submit final payment may result in cancellation of services

Accepted payment methods will be communicated at booking.

8. Cancellations & Rescheduling

Client Cancellations:

  • Deposits are non-refundable

  • Cancellations made close to the event date may be subject to additional charges (cancellations at no charge must be made 15 days before event date)

Rescheduling:

  • One (1) reschedule may be accommodated based on availability

  • Rescheduled events are subject to current rates

9. Alcohol Responsibility & Liability (Georgia-Specific)

The Client acknowledges and agrees that:

  • The Client is solely responsible for supplying all alcohol

  • Alcohol must be legally purchased and transported

  • The Client is responsible for ensuring all guests consuming alcohol are of legal drinking age under Georgia law

  • Sips by Skyy, LLC assumes no responsibility or liability for alcohol consumption, intoxication, injuries, damages, or legal consequences arising from alcohol served at the event.

Sips by Skyy reserves the right to:

  • Refuse service to any visibly intoxicated guest

  • Discontinue alcohol service if safety concerns arise

  • Ask for ID of guest when necessary before serving that individual a drink

No refunds will be issued if service is reduced or terminated due to guest intoxication or safety concerns.

9.2. Georgia Alcohol Law, Dram Shop, Venue Compliance & Brown- Bagging Acknowledgment

Dry Hire Disclosure.

SipsbySkyy operates as a dry-hire mobile bartending service and, in accordance with Georgia law, does not sell, furnish, provide, purchase, or supply alcoholic beverages. All alcohol served at the event must be legally obtained and supplied by the Client or Host.

Georgia Alcohol Law Compliance.

The Client acknowledges that alcohol service in the State of Georgia is governed by Title 3 of the Official Code of Georgia Annotated (O.C.G.A.). The Client is solely responsible for ensuring that all alcohol present at the event complies with all applicable state and local laws, ordinances, and regulations.

Venue Authorization & Permits.

The Client is solely responsible for confirming that the Venue permits outside alcohol and third-party bartending services. If the Venue or local jurisdiction requires an alcohol permit, temporary event license, or written authorization for alcohol consumption, the Client must obtain and maintain such approvals prior to the event. SipsbySkyy does not verify, apply for, or secure permits on the Client’s behalf.

Georgia “Brown Bagging” Compliance.

Where permitted under Georgia law, alcohol may be served pursuant to Georgia’s “brown bagging” provisions, meaning alcohol must be:

  • Lawfully purchased by the Client or Host;

  • Provided at no charge to guests;

  • Maintained in its original manufacturer-sealed container until opened for service; and

  • Served in a manner that does not constitute the sale, resale, or unlawful distribution of alcohol.

Georgia Dram Shop Disclaimer.

Pursuant to Georgia’s Dram Shop Act (O.C.G.A. § 51-1-40), SipsbySkyy does not knowingly sell, furnish, or serve alcoholic beverages to any person who is under the legal drinking age or who is noticeably intoxicated. Because SipsbySkyy does not provide or sell alcohol and acts solely at the direction of the Client using alcohol supplied by the Client, the Client acknowledges that all responsibility and liability related to alcohol consumption rests with the Client and the Venue, to the fullest extent permitted by Georgia law.

No Liability for Venue or Regulatory Enforcement.

SipsbySkyy assumes no responsibility for venue enforcement actions, regulatory violations, event shutdowns, fines, citations, or penalties resulting from alcohol possession, service, permit issues, or failure to comply with Georgia law or venue rules.

Indemnification.

The Client agrees to defend, indemnify, and hold harmless SipsbySkyy, its owners, employees, contractors, and agents from any and all claims, damages, injuries, fines, penalties, legal actions, or liabilities arising out of or related to alcohol possession, consumption, permits, venue violations, or failure to comply with Georgia alcohol laws.

Right to Refuse or Cease Service.

SipsbySkyy reserves the right, in its sole discretion, to refuse or immediately cease service if Georgia alcohol laws, permit requirements, venue rules, or safety standards are not being followed. In such cases, no refunds shall be issued.

10. Alcohol Liability Waiver (Georgia)

To the fullest extent permitted by Georgia law, the Client agrees to release, waive, and hold harmless Sips by Skyy, LLC, its owners, employees, and contractors from any and all claims, damages, injuries, losses, or legal actions arising from:

  • Alcohol consumption

  • Guest intoxication

  • Underage drinking

  • Alcohol-related incidents

The Client accepts full legal responsibility for alcohol-related risks at the event.

11. Guest Conduct & Safety

The Client is responsible for the behavior of all guests. Sips by Skyy may suspend or terminate services if:

  • Guests behave aggressively or dangerously

  • Illegal activity occurs

  • The environment becomes unsafe

    No refunds will be issued in such cases.

12. Setup Requirements

The Client must provide:

  • A safe, accessible service area

  • Adequate space for bar setup

  • Access to water and/or power if required

Delays caused by inadequate setup conditions may reduce service time without refund.

13. Outdoor Events & Weather

For outdoor events:

  • A covered service area must be provided

  • Severe weather may require service modification or suspension

  • Sips by Skyy is not responsible for weather-related disruptions beyond reasonable control.

14. Force Majeure (Georgia)

Sips by Skyy, LLC shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to acts of God, severe weather, natural disasters, power outages, government orders, public health emergencies, illness, injury, or venue closures (“Force Majeure Events”).

In such cases:

  • Deposits remain non-refundable

  • Services may be suspended, rescheduled, or canceled at Sips by Skyy’s discretion

  • Credits or rescheduling may be offered based on availability

15. Limitation of Liability (Georgia)

To the fullest extent permitted by Georgia law, Sips by Skyy, LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from services provided.

16. Indemnification

The Client agrees to indemnify and hold harmless Sips by Skyy, LLC from any claims, damages, liabilities, or expenses arising from:

  • Guest conduct

  • Alcohol consumption

  • Venue conditions

  • Client-provided alcohol or equipment

17. Venue Compliance & Permits (Georgia)

The Client is responsible for ensuring the venue complies with all applicable city, county, and state laws, including permits and alcohol regulations.

SipsbySkyy is not responsible for venue violations.

18. Client-Provided Glassware

If the Client elects to provide their own glassware, all glassware must be clean, event-ready, and sufficient in quantity prior to the start of service. SipsbySkyy shall not be responsible for washing, sanitizing, transporting, or storing Client-provided glassware.

The Client assumes full responsibility for any loss, damage, or breakage of Client-provided glassware occurring during the event. SipsbySkyy is not liable for any injuries, damages, or claims arising from the use, handling, or condition of Client-provided glassware.

SipsbySkyy will make reasonable efforts to handle Client-provided glassware with care; however, normal wear, accidental breakage, and incidental damage may occur and shall not be grounds for refund or liability.

19. Intellectual Property

All branding, menus, service concepts (including Mood by Skyy™), and materials remain the intellectual property of Sips by Skyy, LLC and may not be copied or reproduced without permission.

20. Insurance

Service Provider maintains its own business liability insurance coverage.

21. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia.

22. Severability

If any provision of this Agreement is deemed unenforceable under Georgia law, the remaining provisions shall remain in full force and effect.
